Divorcio

El divorcio especial o “divorcio al vapor” es un procedimiento instituido especialmente para extranjeros o dominicanos no residentes en el país en caso de divorcio por mutuo consentimiento.

 

Al igual que en el procedimiento ordinario de divorcio, y debido a que los cónyuges se divorcian por mutuo consentimiento, la ley exige que se suscriba un acuerdo formal de separación donde se haga constar cuestiones como la división de los bienes comunes, la custodia de los hijos nacidos dentro del matrimonio en caso de haber alguno, y las pensiones alimenticias que deberá pasar el esposo a su esposa, durante el procedimiento de divorcio, e hijos menores de edad, después del mismo.  En el mismo, de manera expresa, se debe atribuir competencia a un Juez de Primera Instancia. Dicho acuerdo debe ser suscrito por ante un Notario Público de la jurisdicción del domicilio del matrimonio, traducido al español y ambos apostillados por la autoridad correspondiente.

 

Los cónyuges podrán divorciarse por mutuo consentimiento siempre que por lo menos uno de ellos se presente a la audiencia, y el otro sea representado por un apoderado especial mediante un Poder Notarialque evidencie que el mismo  ha aceptado los términos del acuerdo. 

 

El cónyuge que no se presente a la audiencia puede ejecutar el poder notarial de una de las siguientes maneras:

 

  1. Ante un Notario Público, este debe ser traducido al español y ambos apostillados por la autoridad correspondiente.
  2. Presentarse ante una Oficina Consular dominicana. Ver Poder Notarial/ Divorcio por Mutuo Acuerdo

 

El cónyuge que comparezca a la audiencia debe presentar al tribunal apoderado un documento de identificación, tal como cédula de identidad, pasaporte o licencia de conducir. Además del acuerdo de separación y el poder notarial mencionado anteriormente, información adicional podría ser necesaria.

  • Certificado de nacimiento en el caso de los niños nacidos en el matrimonio que son menores de edad.
  • Copia certificada del acta de matrimonio.

 

Para que la sentencia de divorcio tenga validez en los Estados Unidos deberá ser legalizada en la Procuraduría General de la República y apostillada por el Ministerio de Relaciones Exteriores.

La Embajada de la República Dominicana entiende que a través del Internet, se ofrecen divorcios en la República Dominicana sin necesidad de que al menos uno de los cónyuges se presente de manera personal ante el tribunal en Santo Domingo, sin el consentimiento mutuo. La Embajada advierte que estos divorcios son ilegales y no son reconocidos por los tribunales dominicanos ni por los tribunales de los Estados Unidos.

Divorce

A special divorce or “Fast Divorce” is a quick divorce procedure for divorces by mutual consent designated especially for foreigners and Dominicans living abroad.

 

As in regular divorce procedures and because the divorce is by mutual consent, the law requires the signing of a formal separation agreement, stating issues such as the division of the common property, custody of the children if it’s the case, and the alimony to be paid by the husband to his wife and under aged children during the divorce proceedings and thereafter. This agreement must confer competence to a judge in the Dominican Republic. This agreement must be signed before a public notary under the jurisdiction of the marriage’s domicile, translated into Spanish and both the original and the translation Apostilled by the appropriate authority.

 

The spouse who is not present at the hearing may execute the power of attorney in one of the following ways:

 

  1. Before a public notary, this must be translated into Spanish and both the original and the translation Apostilled by the appropriate authority.

The spouse who appears at the hearing must submit an identification document, such as passport or driver's license. Besides the separation agreement and power of attorney mentioned above, additional information may be necessary.

  • Birth certificate in the case of minor children born in the marriage.
  • Certified copy of the marriage certificate.

 

For the divorce to be valid in the United States, it must be legalized by the Attorney General's Office and apostilled by the Foreign Ministry.

The Embassy of the Dominican Republic understands that divorces are offered through the Internet without the requirement of the presence of at least one of the spouses in court. The Embassy warns that these divorces are illegal and are not recognized by the Dominican courts or by the courts in the United States.
